Terms of Use

These Terms are an agreement between the account holder and Noctryix LLC. By creating or using a Drawtryix account, you agree to these Terms and acknowledge the Privacy Policy.

1. Age-based accounts

You must be at least 13 to create your own account. If you are under 18, you represent that your parent or legal guardian has reviewed and permitted your use of Drawtryix. Players under 13 may use only a player profile on an account created and controlled by their parent or legal guardian. The account holder is responsible for account security, purchase approval, and activity by people they authorize.

Do not provide a false birthday or bypass age-based permissions. Do not give an under-13 player independent access to account, privacy, social, or payment settings. Use a nickname rather than a minor's full legal name in a player profile.

2. What Drawtryix provides

Drawtryix provides drawing tools, AI-assisted 2D character generation, optional 3D conversion, private character storage, games, player profiles, private multiplayer features, and virtual Tryix or other in-service rewards. Features may change as we improve safety, reliability, and creative play.

We use automated safety checks and, when a report, support request, security event, or legal obligation requires it, review by authorized personnel. That review is limited to prohibited content, abuse, security, reliability, and user-safety purposes.

3. User content

“User Content” includes drawings, uploads, prompts, character names, creative instructions, and other material submitted through the account. You keep any rights you have in User Content.

You grant Noctryix LLC a limited, non-exclusive license to host, copy, transform, privately display, moderate, and transmit User Content only as needed to operate, secure, and support the requested Drawtryix features. You confirm that you have permission to submit the content.

Do not submit:

• Another person's private information or image without permission.
• Copyrighted characters, artwork, or media you do not have permission to use.
• Sexual, exploitative, hateful, graphic, threatening, or illegal material.
• Content identifying a child's home, school, contact details, precise location, or passwords.
• Malicious code or material intended to disrupt the service.

4. AI-generated content

AI results may be unexpected, incomplete, similar to another result, or unsuitable. Review a generated character before using it, and supervise younger players. Drawtryix does not guarantee that an output is unique, error-free, or eligible for copyright, trademark, or other intellectual-property protection.

Drawtryix may reject, pause, or remove a generation when needed for safety, provider requirements, law, technical limits, or suspected abuse. A 3D result can differ from the 2D drawing because automated modeling must infer shape, materials, and movement.

5. Child safety and multiplayer

Never use Drawtryix to contact, groom, bully, threaten, exploit, impersonate, or obtain personal information from a child. Do not attempt to move a child interaction to another service.

In multiplayer, use only age-appropriate display names and in-game interactions. Parents should supervise younger players and review the Safety Center. We may restrict accounts, interactions, or content while investigating a report.

6. Tryix, rewards, and purchases

Tryix and similar game rewards are limited virtual items. They are not legal tender, have no cash value, and may not be sold, transferred, or redeemed for money except where law requires. They may be used only for eligible Drawtryix features and items.

• The account holder is responsible for every purchase made through the account; minors need parent or guardian permission.
• The price or Tryix cost must be shown before a paid action is confirmed.
• A generation charge may begin when provider processing starts.
• Any refund, replacement, or credit terms shown on the purchase screen apply in addition to rights provided by law.
• If provider processing fails before a usable result is delivered, contact support so the transaction and job record can be investigated for an appropriate retry, replacement, credit, or refund.

We encourage you to contact contact@noctryix.comfirst so we can investigate, but contacting us does not limit any right available under applicable law.

7. Acceptable use

You may not:

• Break the law or violate another person's rights.
• Circumvent account, age, profile, safety, moderation, quota, rate-limit, or payment controls.
• Scrape, reverse engineer, resell, or exploit the service except where law expressly permits.
• Use automation that burdens the service or manipulates games or rewards.
• Access another person's account or private content.
• Use Drawtryix content or outputs to train a competing AI model without written permission.
• Misrepresent an AI-generated character as an official character or endorsement of another person or company.

8. Suspension, account closure, and deletion

The account holder may delete profiles and creations using available account controls, visit the Account and Data Deletion page, or contact support to close the account. We may limit or suspend an account to protect users, investigate misconduct or fraud, comply with law, or address a material violation.

Account closure is subject to the retention rules in the Privacy Policy and any records we must keep for legal, payment, safety, or fraud-prevention purposes.

9. Third-party services and availability

Drawtryix relies on hosting, authentication, AI, storage, and payment providers. Their services may occasionally be unavailable or change. Google sign-in and other optional provider features may also be subject to that provider's terms.

We work to keep Drawtryix reliable but do not promise uninterrupted or error-free service. Maintenance, safety issues, provider outages, or events outside our control may affect availability.

10. Disclaimers and limits

To the fullest extent permitted by law, Drawtryix is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms limits consumer rights or warranties that cannot legally be waived.

To the fullest extent permitted by law, Noctryix LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, lost profits, lost data, or loss caused by unauthorized account access. Our total liability arising from Drawtryix will not exceed the greater of $100 or the amount the account holder paid to Drawtryix during the 12 months before the claim. These limits do not apply where prohibited by law.

11. Changes, law, and disputes

We may update these Terms and will provide notice of material changes before they take effect. If the account holder does not agree, they may stop using Drawtryix and close the account.

Before filing a formal claim, contact support and allow 30 days to try to resolve it informally. These Terms are governed by Nevada law, without regard to conflict-of-law rules. Court proceedings must be brought in the state or federal courts located in Clark County, Nevada, unless applicable consumer law permits another location.
